Nude pics have police in hot water

The Culpeper Police Department is facing lawsuits from two Culpeper residents who say their privacy was violated when sexually explicit pictures on a cell phone were deliberately shared among officers and deputies after an arrest.

Filed late last month in U.S. District Court in Charlottesville, the plaintiffs, Nathan Newhard and Jessie M. Casella, each seek unspecified compensatory damages and $350,000 in punitive damages.
Named in the suits are the CPD, Chief Scott Barlow and a former sergeant alleged to have distributed the photos. See civil complaint filed
The six-count civil complaints allege deliberate indifference to the plaintiffs’ constitutional rights, violations of their privacy, “outrageous and shocking” conduct, defamation, intentional infliction of emotional distress and failure of Barlow and the department to adequately train, supervise and discipline officers.

A court date has not been set.

According to the complaints, the incident began during the early morning hours of March 30, 2008, when Newhard was arrested by an unidentified town officer and charged with DUI and three other misdemeanors.

While in custody, the complaint says, Sgt. Matt Borders gained control of Newhard’s cell phone, which contained nude photographs of Casella, his girlfriend.

“Borders then alerted other officers in the station house so they could view the private picture messages without permission,” says the complaint.

After alerting officers in the building, Borders is accused of using his police radio to invite other officers to view the pictures at the station.

“Several officers not associated with the arrest of Nathan Newhard travelled to the Town of Culpeper Police Department headquarters to view the private picture messages,” the complaint states.

“Defendant Borders’ actions of displaying the private explicit picture messages of plaintiff Casella were brutal, demeaning and shocking to the conscience,” the complaint continues.

“Borders’ conduct offended the generally accepted standards of decency when he announced over the (radio system) that other town officers who wanted to see the nude pictures should come into the station.”

According to the lawsuit, an unidentified sheriff’s deputy brought the situation to the couple’s attention. As a result, Newhard claims he was forced to resign his teaching position with Culpeper County Public Schools after news of the incident was leaked to school officials.

Casella, a specialist in equine hoof care, also says the incident seriously harmed her professional career.

Barlow confirmed Friday afternoon that Borders resigned in December. Borders is the only person other than Barlow identified by name in the suit.

Barlow said by e-mail that the town had not officially been served with the suit and stopped short of directly linking the suit and last year’s alleged incident.

“We did receive and investigate an internal complaint that is very likely in reference to this,” Barlow said. “I am confident that we handled the complaint appropriately and professionally. Based on a potential pending lawsuit, I cannot comment any further.”

Veronica Robinson, one of two attorneys representing the plaintiffs, said their investigation recently uncovered new information and the complaint filed last month will likely be amended to include new information as it is discovered.

“We do have some people who gave us information that the information was shared outside the Police Department,” she said. “The more we learn, the more we see the type of case we have.”

OK, Aunt Bea..Now I understand…It is sad to see the old families dying out or leaving after many generations of living in Culpeper but that is the way of the world.  Often new people coming in want to make a name for themselves right away instead of establishing themselves through hard work and gaining recognition through lifestyle rather than bluster.  Culpeper was, at one time, “small town America” but sadly , no more.  I hope that future police officers , and others, learn a lesson from all this and conduct themselves professionally.  Maybe they should have a course in morals and ethics.  But who would teach it??????

According to my breakfast group, scottie boys are the people who have moved here from other areas, and now they want to change everything, overthrow all the officials, police, deputies.

Aunt Bea…Just out of idle curiosity, what is a Scottie boy?  I’ve never heard that expression before but since I’m not a boy maybe this is why.  Am I wrong or was there not more than one officer involved in this? I thought I read that officers were called in to see the photos. As I don’t live in Culpeper anymore I am not familiar with Chief Barlow or his force but having been born and raised in Culpeper I retain a great interest in the place I call home and I hate to see these kinds of actions taking place. What these officers did was wrong and I’m sure they knew it and what the cell phone owner did was really, really stupid but that was his business and not to be displayed for all to see.

All you Scottie boys need to stop trying to use this article to gain support.  It had nothing to do with the Sheriff, and Roy was never the Sheriff.  The town police are not elected and are totally separate from the Sheriff’s office.  And Barlow is a good man who is dealing with a case of one officer doing something stupid, so give it a rest.

change2be…I lived in Culpeper over 50 years and no I didn’t hear these kinds of things back them…OH!!!  and by the way Roy was NOT sheriff.. He was police chief. Not only that he was a Boy Scout troopmaster and joined in many other civic organizations.  His contributions to the community were many and varied. I can’t recall, during either Jamison’s or Peters’ tenures this kind of smut occuring.  Are you defending this behavior???

Rogersk-Are you so naive to believe that when Roy Jamison was Sheriff that there wasn’t some questionalbe behavior going on with the deputies back then? I’ve been here over 50 years so don’t think everyone was so perfect with Jamison or when Peters was Sheriff. None of the deputies or the PD are without some kind of blemish. Some just haven’t gotton caught.

RIGHT!!!!  I’m sure they were just trying to identify the subject.  I wonder if she had any tattoos or identifying marks or scars.  Yes, it was stupid of the owner to leave the photo on the phone but do you REALLY believe the motives of the officers were pure?  If so, I have a gold mine on the corner of Main and Davis I’d like to sell you.

Since no one knows exactly what happened, let’s speculate: With the number of cellphones reported stolen, could the officer have been attempting to verify the owners name and pressed the wrong key by mistake? Once the photo appeared, could the person be mistaken for a minor? If so, wouldn’t it be prudent to see if anyone recognized her? It appears the photo was kept within the law enforcement community and no “Can You Identify This Girl” posters were made and hung up and down Main St. It may have been poor judgment on the officer’s part; but, it was plain stupidity on the part of the cell phone owner and his girlfriend. I would say that people this dumb can’t be humiliated or suffer depression and are not entitled to soak the taxpayer for their stupidity.
