Nude pics have police in hot water

The Culpeper Police Department is facing lawsuits from two Culpeper residents who say their privacy was violated when sexually explicit pictures on a cell phone were deliberately shared among officers and deputies after an arrest.

Filed late last month in U.S. District Court in Charlottesville, the plaintiffs, Nathan Newhard and Jessie M. Casella, each seek unspecified compensatory damages and $350,000 in punitive damages.
Named in the suits are the CPD, Chief Scott Barlow and a former sergeant alleged to have distributed the photos. See civil complaint filed
The six-count civil complaints allege deliberate indifference to the plaintiffs’ constitutional rights, violations of their privacy, “outrageous and shocking” conduct, defamation, intentional infliction of emotional distress and failure of Barlow and the department to adequately train, supervise and discipline officers.

A court date has not been set.

According to the complaints, the incident began during the early morning hours of March 30, 2008, when Newhard was arrested by an unidentified town officer and charged with DUI and three other misdemeanors.

While in custody, the complaint says, Sgt. Matt Borders gained control of Newhard’s cell phone, which contained nude photographs of Casella, his girlfriend.

“Borders then alerted other officers in the station house so they could view the private picture messages without permission,” says the complaint.

After alerting officers in the building, Borders is accused of using his police radio to invite other officers to view the pictures at the station.

“Several officers not associated with the arrest of Nathan Newhard travelled to the Town of Culpeper Police Department headquarters to view the private picture messages,” the complaint states.

“Defendant Borders’ actions of displaying the private explicit picture messages of plaintiff Casella were brutal, demeaning and shocking to the conscience,” the complaint continues.

“Borders’ conduct offended the generally accepted standards of decency when he announced over the (radio system) that other town officers who wanted to see the nude pictures should come into the station.”

According to the lawsuit, an unidentified sheriff’s deputy brought the situation to the couple’s attention. As a result, Newhard claims he was forced to resign his teaching position with Culpeper County Public Schools after news of the incident was leaked to school officials.

Casella, a specialist in equine hoof care, also says the incident seriously harmed her professional career.

Barlow confirmed Friday afternoon that Borders resigned in December. Borders is the only person other than Barlow identified by name in the suit.

Barlow said by e-mail that the town had not officially been served with the suit and stopped short of directly linking the suit and last year’s alleged incident.

“We did receive and investigate an internal complaint that is very likely in reference to this,” Barlow said. “I am confident that we handled the complaint appropriately and professionally. Based on a potential pending lawsuit, I cannot comment any further.”

Veronica Robinson, one of two attorneys representing the plaintiffs, said their investigation recently uncovered new information and the complaint filed last month will likely be amended to include new information as it is discovered.

“We do have some people who gave us information that the information was shared outside the Police Department,” she said. “The more we learn, the more we see the type of case we have.”

Oh, the horses really were a picky bunch, weren’t they.  From what I know about horse owners and serious riders and competitors—they’re a pretty down-to-earth bunch and have a healthy sense of humor.  This type of thing would not bug them at all. 

What would bother them is a DUI problem because the hoof care provider might not be sober or might miss appointments.  That would be a problem.

1. Only stupid people post nude pictures on anything electronic - it never stays “private” - what idiots.
2. If 1 officer does something stupid or immoral or unethical or whatever - it is only that 1 person.
3. I’m sure nothing can be said about the IA investigation or anything related to this suit until it goes in front of a judge.
4. I do not believe Officer Borders, because he was not a sergeant any longer, was still a supervisor when he left….so, folks, something was done about something.
5. I agree, because it’s in civil court - it really is about money. 

They caused themselves the embarassment—what if he misplaces his phone…some average person picks it up and looks through it - shares it….does the idiot still have the nude pics on it?

Final question - what KIND of female, or male, puts themselves in that kind of situation - nude pics on an electronic device?  A really stupid one or someone who WANTS the attention?

if there were town pd that were told to leave another pd so there would be no scandal and then they came to cpd.they were told to leave over steroid use and sales.i know who you are but no one will listen.it is funny how these little things can turn to big things.dont forget armed pd in local bars drunk and fighting.now they are porn pedlers.lawman i have lived in culpeper for over 30 years and yes the cpd is a joke,maybe you are a good cop i hope so. the chief is lazy and just wants a check.  one day someone will listen and clean it up.

I wouldn’t be so quick to judge and just believe one slant of the story when you’ve heard nothing from the other side…  Times are tough and people need money - perhaps this is one way they think they can get it by “tweaking” the actual facts or leaving out pertinent details.  To me, it sounds like the sheriff’s deputy had a bone to pick with the PD when he told the couple rather than the chief.

I don’t agree that the Culpeper Town Police are a joke ed.  Unfortunately law enforcement officers come from the general public.  Yes some get themselves into situations like this one but it should not reflect on those who are doing a great job.  Did you put your complaint in writing?  Not easy to document complaints unless written and copies kept by those making a complaint. 

Sgt. Borders resigned but we will not know whether or not it is related to this incident because personnel issues are not public information under law.  If he used his radio any transmissions with the 800mhz system will be recorded unless the officers used a portable to portable channel.  Not sure how long CPD keeps their recordings. 

Please don’t get the impression that all law enforcement officers conduct themselves in such a way.  We weed out the bad ones.

I do wonder how the Sheriff’s Deputy knew about the incident.

I TOLD THE CHIEF OF A PROBLEM WITH ONE OF HIS OFFICERS HE DID NOTHING.THE TOWN PD IS A JOKE AND I HAVE SAID IT MANY TIMES BEFORE.THIS IS JUST A SMALL PROBLEM WAIT FOR THE REAL GOOD STUFF TO COME OUT YOU WILL BE SHOCKED.THE CHIEF AND THE DRUG USERS MUST GO WE KNOW WHO YOU ARE.LEAVE NOW BEFORE YOU GET CHARGED JUST GO AWAY

This is a big problem.  When law enforcement officers take cell phones into possession for an arrested individual they cannot view what is on a cell phone or any electronic device like an Ipod.  All property on an individual is placed on an inventory list and placed in the property room where the individual arrested can get the items back upon their release.

If the device is related to the crime a search warrant must be obtained before anything on the device can be viewed by law enforcement.

What Sgt. Borders did was not only unlawful but is also an issue of moral conduct.  He is a supervisor and should know better. 

Although being civil and not criminal I would consider this misconduct for any law enforcement officer and would expect discipline for violations of department general orders.

Law enforcement and school officials confiscate cell phones at school every day.  Neither law enforcement, school officials or teachers can view them.  It is a violation of privacy and against the law.

Law enforcement officers when sworn take an oath to uphold all laws.  In the oath it states “uphold the constitution”.  Privacy is protected under this constitution.  Law enforcement officers like myself are not above the law.  We work for the people and must be held accountable for inappropriate actions or behavior.

In my professional opinion it would have been appropriate for at the minimum a demotion in rank.  Also all officers involved who viewed the pictures should have also been disciplined because they too were involved in misconduct.
