RICHMOND— Gov. Tim Kaine is calling Virginia lawmakers into special session to address a recent U.S. Supreme Court ruling that is jeopardizing criminal prosecutions.
Kaine said at a news conference Wednesday that the session will be held Aug. 19.
The Supreme Court ruled in June that prosecutors must make forensic examiners available for defense cross-examination about lab reports on certain evidence. Defense lawyers already are citing the ruling in Virginia courts.
Virginia law puts the onus on defendants to subpoena the scientists if they want to challenge lab reports. The Supreme Court ruling shifts the burden to the prosecution to make the forensic examiners available.
